Real Estate Scams in Kenya

Top 10 Real Estate Scams in Kenya (2025)

1. 🏞️ “Prime Land at Throwaway Prices” (Most Common!)

“1/8 acre in Kitengela — Ksh 800,000 only! Near SGR, tarmacked road, ready for building!”

The Scam: Fake sellers advertise non-existent or already-sold plots. Use stolen title deeds or forged documents. Disappear after “deposit” via M-Pesa.

Red Flags:
❌ No physical site visit allowed
❌ “Urgent sale — price valid today only!”
❌ Refusal to share title deed or conduct official search
❌ Agent not EARB-licensed

🛡️ Prevention: ALWAYS conduct official search at Lands Registry (Ksh 500). Verify seller’s ID matches title.

LAND

2. 🏢 “Off-Plan Apartment with 50% Discount” (Ghost Developments)

“Luxury 2-bed in Upper Hill — Ksh 6M (was Ksh 12M)! Pay 30% now, move in 2026!”

The Scam: Scammers create fake brochures, websites, even “sales offices.” Take deposits — then vanish. No NCA approval, no construction.

Red Flags:
❌ No CR12 or NCA registration for developer
❌ No physical construction site
❌ Pressure to pay cash or to personal M-Pesa
❌ No lawyer involved

🛡️ Prevention: Demand NCA & county approvals. Visit site. Use escrow. Never pay without lawyer.

3. 👔 Fake “Licensed” Agents (EARB Imposters)

“I’m EARB-licensed agent Peter — here’s my certificate. Let’s close this deal fast!”

The Scam: Scammers forge EARB certificates or use real agent’s name. Collect commission + deposit — then ghost you.

Red Flags:
❌ Certificate looks blurry or unprofessional
❌ Refusal to let you verify license at earb.go.ke
❌ No physical office — only WhatsApp/phone
❌ Asks for “processing fee” or “EARB clearance fee”

🛡️ Prevention: VERIFY license LIVE at earb.go.ke/registered-agents . Call EARB: 0720 500 555.

4. 📄 “Agreement for Sale” Instead of Title Transfer

“Sign this agreement — I’ll transfer title next month. Pay deposit now!”

The Scam: Seller takes deposit, signs “agreement” — but never transfers title. You have no legal ownership. Land may be sold to 5 other people.

Red Flags:
❌ Seller avoids Lands Registry
❌ “Transfer fees too high — let’s wait”
❌ No lawyer present
❌ Seller in hurry

🛡️ Prevention: ONLY accept title deed transfer at Lands Registry. “Agreement for Sale” is NOT ownership.

AGREEMENT

5. 💸 Fake Landlord + M-Pesa Deposit Scam (Rentals)

“I’m abroad — send Ksh 50,000 deposit via M-Pesa to secure this Kilimani apartment. Keys waiting!”

The Scam: Scammer poses as landlord. Sends fake photos, fake ID. Takes deposit — apartment doesn’t exist or is already rented.

Red Flags:
❌ Landlord “out of country” — can’t meet
❌ No lease agreement
❌ Asks for full deposit before viewing
❌ Refuses video call or site visit

🛡️ Prevention: ALWAYS visit property. Meet landlord. Sign lease. Pay deposit AFTER signing — via traceable method.

6. 🏗️ Double Selling / Multiple Buyers Scam

“You’re the ONLY buyer!” — while 5 others paid deposits on same property.

The Scam: Seller takes deposits from multiple buyers — plays them against each other. Disappears with all money.

Red Flags:
❌ Seller rushes you — “others interested!”
❌ No caveat placed on title after your deposit
❌ Refuses to give you copy of title or search

🛡️ Prevention: After paying deposit, immediately place a CAVEAT at Lands Registry (Ksh 1,000). Freezes further sales.

7. 🧾 Fake Clearance Certificates (Land Rates, NEMA, etc.)

“All clearances paid — here’s the receipt!” (Fake document)

The Scam: Seller forges land rates, NEMA, or county clearance certificates. After you buy, you’re hit with massive back fees or demolition order.

Red Flags:
❌ Receipts look photocopied or unofficial
❌ No official stamp or QR code
❌ County office has no record

🛡️ Prevention: Verify ALL clearances directly at county office or via e-Citizen. Don’t trust paper copies.

RENTAL AGREEMENT

8. 📱 Social Media “Flash Sale” Scams (Facebook, TikTok, WhatsApp)

“FLASH SALE! 3-bed in Ruiru — Ksh 4.5M! Pay Ksh 100K deposit NOW via M-Pesa to 07XX XXX XXX!”

The Scam: Fake ads with stolen photos. Scammers create urgency — “only 2 left!” — to bypass due diligence.

Red Flags:
❌ Ad created <7 days ago
❌ No company name or physical address
❌ Payment to personal number
❌ No EARB license shown

🛡️ Prevention: Reverse image search photos. Verify agent/company. NEVER pay without verification.

SOCIAL MEDIA

9. 🏦 “Mortgage Facilitator” Scams

“I’ll get you a mortgage at 8% interest — just pay Ksh 50,000 ‘processing fee’ first!”

The Scam: Fake “bank agents” collect fees — then disappear. No mortgage application ever made.

Red Flags:
❌ Asks for upfront cash “to secure rate”
❌ No bank email or office visit
❌ Uses personal M-Pesa

🛡️ Prevention: ONLY deal with bank directly. No legitimate bank charges upfront fees for mortgages.

10. 🌐 Fake Property Portals & Clone Websites

“BuyRentKenya.co.ke” (fake) vs “BuyRentKenya.com” (real)

The Scam: Scammers create fake websites mimicking legit portals. List non-existent properties. Collect “booking fees.”

Red Flags:
❌ Slight misspelling in URL
❌ No SSL (https://) or padlock icon
❌ Poor grammar, stock photos
❌ Payment to personal account

🛡️ Prevention: TYPE official URL manually. Never click ads. Check WHOIS registration date.
